Freedom of speech is part of first amendment of US Constitution and this is the reason why this right is highly respected and among the most popular arguments used in many cases. But lately, there’s a new precedent on a controversial case in Cinco de Mayo California. The case itself about a school principal who is allegedly accused to violate freedom of speech as he told group of students wearing American flags on their shirts to turn their shirt inside out otherwise they must go home.
There are many different thoughts and long lasting arguments regarding this case. Many believe that t shirts worn by group of students are part of their self-expression. But this argument doesn’t apply to Chief US Chief U.S. District Judge James Ware of San Francisco. He said that what the school principal did was forecast the potential disruption caused by those t shirts and that made him entitled to take preventive action. His argument about the latest clothing clashes between Mexican American and Anglo Students on the Mexican holiday.
The Live Oak High School, where the case took place has high ethnically charged atmosphere and any form of provocation could turn into a huge clash. Moreover, as the biggest responsible of the principal is to create safety environment on his school; he doesn’t need to wait until the disruption occurs to take preventive action.
